Pasada Terms and Conditions

Welcome to Pasada. These Terms and Conditions ("Terms") govern your access to and use of the Pasada mobile application (the "App") and related services. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.
1. Acceptance of Terms
By creating an account, accessing, or using Pasada, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Pasada.
2. Description of Service
Pasada is a ride-hailing application that connects passengers with modernized jeepney services in the Philippines. Currently, the App supports the route from Bayan to Malinta. The App enables you to:
- Book rides on supported routes
- Track your ride in real-time
- View ride history and manage your account
- Communicate with drivers regarding your ride
Pasada acts as an intermediary platform connecting passengers with transportation services. We do not own or operate the vehicles used for transportation.
3. User Accounts and Registration
3.1 Account Creation
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- You must provide accurate, current, and complete information during registration.
- You are responsible for maintaining the confidentiality of your account credentials.
- You must notify us immediately of any unauthorized use of your account.
3.2 Account Requirements
- You must provide a valid email address and phone number.
- Your phone number must be a valid Philippine mobile number.
- You agree to keep your account information updated.
3.3 Account Security
- You are responsible for all activities that occur under your account.
- You must not share your account credentials with third parties.
- Pasada is not liable for any loss or damage arising from unauthorized access to your account due to your failure to maintain account security.
4. Use of the Service
4.1 Permitted Use
You may use the App solely for lawful purposes and in accordance with these Terms. You agree to:
- Use the App only for booking legitimate transportation services
- Provide accurate pickup and drop-off locations
- Be present at the designated pickup location at the scheduled time
- Treat drivers and other users with respect and courtesy
4.2 Prohibited Activities
You agree NOT to:
- Use the App for any illegal or unauthorized purpose
- Violate any applicable laws or regulations
- Interfere with or disrupt the App's functionality
- Attempt to gain unauthorized access to the App or related systems
- Use automated systems (bots, scrapers) to access the App
- Impersonate any person or entity
- Harass, abuse, or harm drivers or other users
- Book rides fraudulently or without intent to use the service
- Share false or misleading information
- Use the App to transport illegal substances or items
- Violate any intellectual property rights
5. Booking and Ride Services
5.1 Booking Process
- When you book a ride, you enter into a contract with the driver/transportation provider, not with Pasada.
- Pasada facilitates the connection but is not a party to the transportation contract.
- Booking availability is subject to driver availability and route coverage.
5.2 Cancellation Policy
- You may cancel a booking in accordance with the cancellation policy displayed in the App.
- Excessive cancellations may result in restrictions on your account.
- Cancellation fees may apply as specified in the App.
5.3 No-Show Policy
- If you fail to appear at the designated pickup location within a reasonable time, the driver may cancel the ride.
- No-show incidents may result in fees and may affect your ability to use the service.
5.4 Route Limitations
- Currently, Pasada supports the Bayan to Malinta route only.
- Additional routes may be added in future updates.
- Pasada reserves the right to modify, suspend, or discontinue routes at any time.
6. Payment Terms
6.1 Payment Methods
- Pasada currently accepts cash payments only, in accordance with regulations set by the Land Transportation Franchising and Regulatory Board (LTFRB).
- Payment is made directly to the driver upon completion of the ride.
- Pasada does not process payments but may facilitate payment information exchange.
6.2 Fares
- Fares are determined by the transportation provider and may vary based on distance, time, and other factors.
- Fare estimates provided in the App are approximate and may differ from the actual fare.
- You are responsible for paying the agreed-upon fare to the driver.
6.3 Refunds
- Refund policies are determined by the transportation provider.
- Pasada is not responsible for refunds unless required by applicable law.
7. Location Services
7.1 Location Data
The App requires access to your device's location services to function properly. Location data is used to:
- Identify pickup and drop-off locations
- Provide real-time ride tracking
- Calculate routes and estimated arrival times
- Improve service quality
7.2 Location Permissions
- You must grant location permissions for the App to function.
- You can modify location permissions through your device settings, but this may limit App functionality.
- Location data is handled in accordance with our Privacy Policy.
8. Intellectual Property
8.1 Pasada's Rights
- The App, including its design, features, content, and functionality, is owned by Pasada and protected by intellectual property laws.
- You may not copy, modify, distribute, sell, or lease any part of the App without our written permission.
8.2 User Content
- You retain ownership of any content you submit through the App.
- By submitting content, you grant Pasada a license to use, display, and distribute such content as necessary to provide the service.
9. Disclaimers and Limitations of Liability
9.1 Service Availability
- Pasada provides the App "as is" and "as available" without warranties of any kind.
- We do not guarantee that the App will be uninterrupted, secure, or error-free.
- We reserve the right to modify, suspend, or discontinue the App at any time.
9.2 Transportation Services
- Pasada is not a transportation provider and does not own or operate vehicles.
- We are not responsible for the quality, safety, or conduct of drivers or transportation services.
- You use transportation services at your own risk.
9.3 Limitation of Liability
To the maximum extent permitted by law:
- Pasada shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
- Our total liability shall not exceed the amount you paid (if any) for using the App in the 12 months preceding the claim.
- We are not liable for any loss or damage resulting from:
- Your use or inability to use the App
- Transportation services provided by third parties
- Unauthorized access to your account
- Any errors or omissions in the App's content
10. Indemnification
You agree to indemnify, defend, and hold harmless Pasada, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your interaction with drivers or transportation providers
11. Privacy
Your use of the App is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we collect, use, and protect your information.
12. Termination
12.1 Termination by You
- You may stop using the App at any time.
- You may request account deletion by contacting us at contact.pasada@gmail.com.
12.2 Termination by Pasada
We may suspend or terminate your access to the App immediately, without prior notice, if you:
- Violate these Terms
- Engage in fraudulent or illegal activity
- Misuse the App or services
- Fail to pay any applicable fees
12.3 Effect of Termination
- Upon termination, your right to use the App ceases immediately.
- We may delete your account and associated data in accordance with our Privacy Policy.
- Provisions that by their nature should survive termination will remain in effect.
13. Dispute Resolution
13.1 Governing Law
These Terms are governed by the laws of the Philippines, without regard to conflict of law principles.
13.2 Dispute Resolution Process
- In the event of a dispute, you agree to first contact us at contact.pasada@gmail.com to attempt to resolve the matter.
- If the dispute cannot be resolved through direct communication, it may be subject to the jurisdiction of the courts of the Philippines.
13.3 Driver Disputes
- Disputes between you and drivers should be resolved directly with the driver or transportation provider.
- Pasada may assist in facilitating communication but is not responsible for resolving such disputes.
14. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will:
- Notify you through the App or via email
- Update the "Last Updated" date at the top of these Terms
- Provide reasonable notice before changes take effect
Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the App and may delete your account.
15. Compliance with Regulations
15.1 LTFRB Compliance
- Pasada operates in compliance with regulations set by the Land Transportation Franchising and Regulatory Board (LTFRB).
- We reserve the right to modify our services to ensure continued compliance with applicable regulations.
15.2 Local Laws
- You are responsible for complying with all applicable local, state, and national laws when using the App.
- Pasada may restrict access to the App in certain jurisdictions where it is not authorized to operate.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pasada regarding the App.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
16.3 Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
16.4 Assignment
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
